This website and online store (the “Site”) are owned and operated by Punta Brava Apparel, located at Road 130 KM 4.9 Interior, Hatillo, PR 00659 (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you may not use the Site. Our Privacy Policy, Shipping Policy, and Return & Refund Policy are separate documents and are incorporated by reference.

Eligibility
Use of this Site is limited to individuals who are at least eighteen years of age or the legal age of majority in their jurisdiction. By making a purchase, you confirm that you are legally capable of entering into a binding agreement and are authorized to use the chosen payment method.

Orders and Payments
Placing an order through the Site constitutes an offer to purchase. We reserve the right to accept, refuse, or cancel orders at our sole discretion. Accepted payment methods include major credit cards, ATH Móvil (Puerto Rico only), PayPal, and other methods displayed at checkout. Prices are listed in U.S. Dollars (USD). Taxes will be applied where required. We reserve the right to correct pricing errors and to cancel or refund orders placed under incorrect pricing or product availability.

Shipping and Risk of Loss
We ship to Puerto Rico, all fifty U.S. states, and FPO/APO addresses. Processing time is generally two to three business days. Risk of loss passes to the customer once the carrier confirms delivery at the shipping address provided. Punta Brava Apparel is not responsible for delays or losses caused by circumstances beyond our control, including but not limited to weather events, labor strikes, or carrier disruptions. Returns and Refunds
Our Return & Refund Policy governs returns, exchanges, and refunds. In summary, returns are accepted within thirty days of delivery for unused items with original tags attached. Certain items, such as clearance, final sale, or customized products, may not be eligible for return.

Product Information and Variations
We make reasonable efforts to ensure that product descriptions, colors, and sizes are accurate. However, variations may occur due to differences in screen displays or manufacturing tolerances. Such variations are not considered defects.

Intellectual Property
All content, designs, logos, images, and other materials on the Site are the property of Punta Brava Apparel or are licensed to us. Visitors may not reproduce, distribute, or otherwise use this material without prior written consent.

User Content
Visitors may submit content such as reviews, photos, or feedback. By submitting content, you represent that you own or control the rights to that content and grant Punta Brava Apparel a worldwide, royalty-free license to use, display, and reproduce such content. We reserve the right to remove content at our discretion.

Limitation of Liability
Punta Brava Apparel shall not be liable for indirect, incidental, or consequential damages arising out of your use of the Site or products purchased through it. Our total liability to you will not exceed the purchase price paid for the product giving rise to the claim.

Indemnification
You agree to indemnify and hold Punta Brava Apparel harmless from any claims, damages, or expenses, including attorneys’ fees, resulting from your misuse of the Site or violation of these Terms.

Right to Modify or Suspend Services
We reserve the right to change or discontinue any part of the Site, or to suspend or terminate user access, at any time and without notice, if we determine it is necessary.

Force Majeure
We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, government actions, or disruptions in shipping and logistics.

Governing Law and Jurisdiction
These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable United States federal law. Any disputes will be resolved exclusively in the courts located in Puerto Rico.

Changes to These Terms
We may update these Terms & Conditions from time to time. Updates will be posted on this page with a new “Last Updated” date. Continued use of the Site after updates are posted constitutes acceptance of the revised Terms.
